Red Bay man charged with murder
RED BAY – A Red Bay man is in custody after a recent grand jury indicted him for his involvement in a November shooting death that occurred inside the city limits.
Herschel Dale Graham, 50, 806A 10th St. NE, Red Bay, was officially indicted for murder for the Nov. 3 shooting death of 42-year-old David Andrasik, of Franklin 11 North in Red Bay.
According to Red Bay Police Chief Janna Jackson, Graham surrendered to authorities on Wednesday after learning about the indictment.
Jackson said the shooting was reportedly the result of an altercation that took place on Graham’s property between Andrasik, Graham and Graham’s 17-year-old son.
Reports stated that Andrasik was driving his vehicle by Graham’s residence about 5:30 p.m. on Nov. 3 when he got out of his vehicle and got into an argument with Graham’s son.
According to witness accounts, Andrasik and the juvenile continued the argument into Graham’s backyard where Graham reportedly fired the fatal shot.
Reports stated that Graham told authorities he was in fear for his life and the life of his son and that’s why he fired the shot that authorities said struck Andrasik in the chest.
Jackson said a .22 caliber pistol was found at the scene.
Andrasik was transferred to Red Bay Hospital where he died at 6 p.m. as a result of the gunshot wound.
Jackson said Graham was not immediately charged in Andrasik’s death since the shooting occurred on Graham’s property and he claimed self-defense.
Jackson said the case was turned over to the Franklin County District Attorney’s Office to be presented to the January grand jury.
Investigators with the Alabama Bureau of Investigation also assisted with the case.
District Attorney Joey Rushing said Graham’s case will be set for arraignment in March.
Graham is currently being held in the Franklin County Jail on a $100,000 bond.
